This webinar will discuss circumstantial theories of recovery in subrogation cases. The presentation will focus on Res Ipsa Loquitor and the Malfunction Theory, two different tools available to subrogating plaintiffs when direct evidence of a defendant’s negligence is lacking. The presenters will highlight real-world applications of these doctrines showing how they play out in litigation and discuss how to strategically utilize these tools to prevail against recovery targets in litigation.
