In June 2020, the Pennsylvania Supreme Court adopted ethics rule Rule 8.4(g), which prohibits knowingly manifesting bias or prejudice, or engaging in harassment or discrimination upon a number of protected class characteristics.  A Philadelphia attorney filed a subsequent First Amendment challenge to the Rule, contending that it will chill his speech as a lawyer advocating on behalf of student and faculty due process and free speech rights. This Zoom-virtual ethics CLE will explore Rule 8.4(g), the First Amendment challenge, and the legal scope and reach of the Rule.
