No Room for Assumptions: Oregon Supreme Court Reinforces Strict Standard for Tort Waivers [Subrogation & Recovery Law Blog]

As parties increasingly seek to limit liability through contractual disclaimers, the Oregon Supreme Court has issued a clear reminder: tort waivers must be stated in unmistakable terms to be enforceable. Courts will not infer a waiver from context or implication alone.

Cameron is an experienced litigator who focuses his practice on handling a wide variety of large property damage claims involving fires, floods, mechanical system failures, sprinkler system failures, product liability, and other tort and contract claims on behalf of the insurance industry and individual owners. Cameron is experienced in all aspects of litigation, including conducting and defending witness depositions and arguing substantive motions. He is licensed to practice in Washington, Oregon, and Idaho, and also handles cases in Hawaii.

Cameron is co-chair of the firm's Associates Committee and was named a Rising Star by Washington Super Lawyers in 2022. Prior to joining Cozen O’Connor, Cameron practiced at a Seattle-based litigation firm where he handled medical malpractice, personal injury, bad faith, and subrogation matters.

Cameron earned his law degree from University of Washington School of Law, where he was vice justice of Phi Alpha Delta Law Fraternity. Cameron earned his bachelor’s degree from Whitman College.
