When Preconstruction Services Create Expectations: Lessons for Project Participants Before a Construction Contract Is Signed [Consilio Construction Newsletter]

Michael Filbin and Madeline Jenkins, in a recent contribution to the Consilio Construction Newsletter, explain how a recent First Circuit decision underscores that providing preconstruction services does not, by itself, create a contractual right to perform the construction work, highlighting the importance of clearly documenting expectations before a contract is signed.

Madeline practices construction law and has experience representing clients in a variety of litigation matters, including commercial disputes, intellectual property, and construction matters.

Prior to joining the firm, Madeline was a litigator at a national law firm, where she handled matters involving complex commercial disputes. Her background also includes managing teams to support public sector clients, providing litigation support for government contract and admiralty cases, and assisting with complex litigation cases through all stages.

Madeline received her J.D. from The George Washington University Law School in 2023, where she was a senior staff member of the Federal Circuit Board Journal. She graduated from Pennsylvania State University in 2016, where she studied English and art history.
