The PA Department of Environmental Protection (PADEP) is crucial in enforcing the Act. Michael discusses the civil and criminal penalties that the Act authorizes and explains how notices of violation (NOV) can be issued when PADEP identifies a breach from one of its various sources, forcing a party to take a requested action by a specific time.
“I have received calls from clients who have received NOVs requesting that I file an appeal of the NOV. My answer is that an NOV is not a final determination by PADEP, and as such, it is not appealable,” Michael stated.
