Right of Publicity and Fair Use: Sure to Raise Eyebrows [New York Law Journal]

Edward Weisz and Brianne Polito wrote about companies using the name of a celebrity as a tie-in to a product seeking to connote a celebrity's characteristic or feature. Edward and Brianne discussed the recent suit of actress, Brooke Shields, in which the makeup brand Charlotte Tilbury Beauty was offering an eyebrow pencil under the name "Brooke S." Charlotte Tilbury was not referencing Brooke Shields but through consumer reviews it was perceived that it was in reference to the actress.
