New Reimbursement Obligations For Illinois Employers In 2019 [Law360]

Christopher Hennessy, a member in the firm's Chicago office, and Jeremy Glenn, the Chicago office managing partner, co-authored an article in Law360 about new laws in 2019 that will impact Illinois employers. Under an amendment to the Illinois Wage Payment and Collection Act,[1] Illinois employers (with the exception of the state or federal governments) must reimburse their employees for “all necessary expenditures or losses incurred by the employee with the employee’s scope of employment and directly related to services performed for the employer.”[2] The statute defines “necessary expenditures” as “all reasonable expenditures or losses required of the employee in the discharge of employment duties and that inure to the primary benefit of the employer.”[3]
