James Gale was quoted in a Tampa Bay Business Journal article discussing how the cybersecurity firm KnowBe4 is being sued by PacSec3 LLC, a Texas-based "non-practicing entity," for allegedly infringing on its patented technology called "packet flooding defense system." PacSec3, which does not produce products, has also sued other firms over this patent. However, non-practicing entities do not use patented inventions but exploit them by enforcing patent rights.
Jim commented that this is a challenging case for the plaintiff as different parts of the patent have expired or are set to expire in 2024. Jim stated, “The plaintiff has an uphill battle for a number of technical reasons, just appearing from the face of the complaint.” He shared that the damages should be limited if obtained at all.
