Eric Leonard was quoted in a Law360 article discussing the Texas federal court’s decision in Associated General Contractors of America et al. v. U.S. Department of Labor et al., which resulted in issuing a nationwide preliminary injunction blocking parts of the Davis-Bacon Act regulation that governs prevailing wages for publicly funded construction projects over $2,000. According to Eric, the fact that the court issued a nationwide injunction is “notable although not surprising,” given that the plaintiffs’ business operations span across states. "The inclusion of the operation of law provision was very controversial, and the district court provided a sound analysis as to why this provision is not supportable by specifically noting that the DBA … is not self-implementing," he added. "If Congress wants to change that, it can, but DOL's attempt to modify the statute by making the DBA self-implementing was problematic."
