David Barron was quoted in Forbes discussing how the latest CDC mask guidelines impact employers. David cautioned that the, “CDC is not the only authority governing this issue, and employers should still be cognizant of requirements from OSHA and any local/state requirements which may govern masking in the workplace. Second, keep in mind that this new CDC guideline is only for vaccinated workers. Most workplaces will have a mix of vaccinated and non-vaccinated [employees] which will continue to create enforcement issues and concerns about discrimination. Keep in mind that employers are required to accommodate requests for reasonable accommodation which may include both wearing or not wearing a mask, depending upon the nature of the employee’s medical issue.”
