Mailbag: Can we require that employees receive a COVID-19 vaccine?

David Barron discussed with HR Drive whether an employer can force employees to receive a vaccine for COVID-19. David says, "the answer is far from clear." He followed up with, "Employers might look to guidance from federal agencies like the U.S. Equal Employment Opportunity Commission. The EEOC's 2009 guidance document on pandemic preparedness and the Americans with Disabilities Act, released during the H1N1 influenza pandemic and updated this year during the COVID-19 pandemic, said that an employer covered by the ADA may not compel all of its employees to receive an influenza vaccine regardless of their medical conditions or religious beliefs."
