Litigation Likely as New York Frees Tenants from Broker Fees

Leni Cummins explains how new guidance from the New York Department of State could impact landlords in an article in Law 360. Under the new guidance, residential brokers for landlords can no longer require renters to pay their brokerage fees in certain circumstances. Landlords will now need to pay the broker fees themselves and, as a result, may increase rents or  may opt not to list certain apartments with brokers.

"Landlords with a larger number of units or who do not need to rent out their units will likely make economy-of-scale deals with brokers or will choose not to list their units," said Leni.
