What the Industry is Saying About the Federal Rent Law Challenge

Ken Fisher notes that the makeup of the Supreme Court could impact New York's Rent Stabilization Association's and Community Housing Improvement Program's lawsuit challenging the New York State rent stabilization law, in an article in The Real Deal. The federal complaint on constitutional grounds was recently filed following radical legislative expansion of tenant protections. According to Ken, the current makeup of the Supreme Court works in the plaintiffs' favor. 

"The Supreme Court has been more respectful of property rights and more skeptical of the heavy hand of government over the last few years- that's a trend that's anticipated to continue," Ken said. "[The case] might not have had legs 10 years ago."
