As reported by ABC News, Cozen O’Connor’s Labor & Employment attorneys, led by Joseph Tilson, co-chair of the department, were successful in thwarting the Northwestern University’s Football Team’s attempt to unionize, when the NLRB “adopted Tilson’s suggestion” to decline to assert jurisdiction. The NLRB did not rule on the question of whether or not football players were employees, however this decision will make it difficult for any student-athletes at any university to form a union. Under this ruling, a group of athletes could only form a union if it included all players in the conference. Otherwise, a single school with a single union "would not promote labor stability" according to the NLRB.
