Wendy will discuss the types of damages for construction projects, how quantum meruit differs from a "total cost" claim, and arguments for getting around the limitations of liability clauses. She will also discuss whether a contractor can be charged both liquidated damages and consequential damages and how joint venture partners sufficiently protect themselves from damages that may occur due to the fault of one of the partners.
Lawrence Prosen will moderate the panel “Indemnity - the good, the bad, the ugly – what keeps in-house counsel up at night?” Larry and the panelists will discuss indemnification clauses, a brief history/evolution, and both common law and statutory efforts to limit the breadth and coverage of such clauses in the construction context.
