Alycen A. Moss and Elliot Kerzner will present “When an Intentional Act Can Be An Accident: Interpreting the Word ‘Occurrence’ in Liability Insurance Policies” at the Southern Loss Association’s July 2023 Luncheon in Alpharetta, Georgia.

 

The presentation will focus on whether bodily injury or property damage caused by an intentional act can be an “accident” to trigger coverage as an “occurrence” under a liability insurance policy. The presentation will also define “occurrence” in a standard liability insurance policy, and whether intentional conduct that results in unintended injury qualifies as an “occurrence.” Alycen and Elliot will also discuss (1) whether injury caused by the intentional act of a third party qualifies as an “occurrence”; (2) whether faulty workmanship qualifies as an “occurrence.”; and (3) the interplay between the definition of “occurrence” and the expected or intended injury exclusion.
