Federal OSHA has initiated its rulemaking process for the issuance of an upcoming heat stress standard. This follows enforcement guidance issued in September 2021 that clearly indicated that OSHA believes that most heat illness cases in the workplace can be avoided. Jim Sullivan will discuss what to anticipate from OSHA’s rulemaking effort as well as OSHA’s ongoing use of the “general duty clause” in issuing citations against employers in the construction industry.
