Paul Ferland and Jordan Hess will present a Cozen O'Connor webinar titled, "Whose Risk Is It Anyway?" on Wednesday, May 5, 2021. This webinar will focus on the application of co-insurance provisions in property insurance policies. The presenters will discuss sample policy wordings and the effect of co-insurance on claims. They will analyze co-insurance provisions in the context of agreed value policies and, in particular, how these provisions apply in partial loss and total loss scenarios. In doing so, they will review case law and statutes from around the country to identify how courts have interpreted and applied co-insurance provisions generally, and in agreed value policies specifically. Further, they will apply what is reviewed to a case study to see how these provisions work in a real life claim scenario.
The presenters will discuss:
-
Co-insurance provisions generally. What they are, where you find them, and why they exist
-
Agreed Value Policies; their relation to co-insurance, and how they are interpreted
-
Co-insurance/Agreed Value Policy in action – a case study
-
New Lloyd’s proposed property damage valuation and average clause
