Howard Krooks will present on the topic "The New York – Florida Connection:  Understanding the States' Dramatic Differences in Long-Term Care Planning, Elder Law and Special Needs Planning." This presentation will address recent developments in New York and Florida elder law, special needs and long term care planning. Topics that will be addressed includes:

  • The newly enacted penalty period for community based long term care in New York
  • The potential impact on the funding of income into pooled supplemental needs trusts
  • Changes in the way Florida is treating transfers of assets to pooled supplemental needs trusts by individuals age 65 and over
  • Changes in New York's power of attorney statute and the implications thereof in Florida
  • The treatment of assets held in an irrevocable Medicaid Asset protection trust in both states
  • Florida's resistance to adopting the Uniform Adult Guardianship Protective Proceedings Jurisdiction Act
  • Issues regarding the unlicensed practice of law in both states.
