Terri Sutton and Stephen Pate will present a webinar titled, "Not with a Bang But a Whimper—The Restatement of Liability Insurance Two Years Later" on October 23, 2019. This presentation will cover the historical beginning and adoption of the American Law Institute’s Restatement of the Law of Liability Insurance. The presenters will discuss the key points of the Restatement, including policy interpretation, the duty to defend, defending under reservations of rights, the consequences of breaching the duty to defend, the insurer’s duty to settle, when and how an insurer may be held in bad faith, and when and how an insurer may be held liable for the malpractice of retained defense counsel. The presenters also look at the reaction to the Restatement, by courts and legislation.
